is there any chance to get the Ally Update without buying the new updated theme?

Yes, updates are free. You can login to your account and download the latest version – http://appfinite.com/my-account
Also take a look here if you’re trying to update an old version of the theme – http://appfinite.com/topic/ally-1-3-for-genesis-2-0-html5-is-now-available/ ….if not, you can just re-download and install.
